Welcome to TS Capital Management (“Company,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, services, and any content, functionality, or tools provided through the KudoTrade platform in connection with our strategy provision (collectively, the “Services”).
By using our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.

Eligibility

By accessing or using our Services, you represent and warrant that:

• You are at least 18 years of age.

• You have the legal capacity to enter into a binding agreement.

• You are not barred from using the Services under any applicable law or regulation.

Nature of Services

TS Capital Management provides trading strategies via the KudoTrade platform, which uses Pelican Trading’s FCA-regulated copy trading infrastructure.
We do not provide investment advice, portfolio management, or brokerage services. Our role is strictly limited to offering strategies that investors may choose to copy at their own discretion. The Services are intended for informational and educational purposes only.

Risk Disclosure

Trading forex and other financial instruments involves significant risk and is not suitable for all investors. The value of investments may go down as well as up.
You should:

• Carefully assess your financial situation, trading experience, and risk appetite before participating.

• Only trade with capital you can afford to lose.

• Understand that past performance is not indicative of future results.

TS Capital Management will not be liable for any losses or damages incurred through use of the Services. Use of leverage, market volatility, and other risks may result in loss of capital.

Use of the KudoTrade Platform

All trade copying and execution is conducted through KudoTrade, which is regulated by the Mauritius Financial Services Commission.
While the platform utilizes FCA-regulated infrastructure provided by Pelican Trading (a trading name of London & Eastern LLP, FCA FRN: 534484), TS Capital Management is not FCA regulated and is not directly affiliated with Pelican Trading or London & Eastern LLP.
You remain in full control of your capital at all times via the KudoTrade platform.

 

User Responsibilities

You agree not to:

• Engage in any unlawful, abusive, or fraudulent behavior.

• Use the Services to distribute unsolicited or unauthorized advertising.

• Violate any applicable laws or regulations in connection with your use of the Services.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

 

Termination of Access

We reserve the right to suspend or terminate your access to the Services at any time and for any reason, including but not limited to breach of these Terms. Upon termination, you must cease all use of the Services and any materials obtained through them.

 

Disclaimer of Warranties

The Services are provided “as is” and “as available” without any warranties of any kind, either express or implied.
We do not guarantee:

• Accuracy, completeness, or reliability of any content or data.

• That the Services will be uninterrupted, timely, or error-free.

• Future performance or outcomes from use of the Services or strategy.

You acknowledge that any use of our strategies is at your sole risk.

 

Limitation of Liability

To the fullest extent permitted by law, TS Capital Management, its owners, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from your use of, or inability to use, the Services.

 

Governing Law

These Terms and any disputes related to them shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles.

 

Modifications to These Terms

We reserve the right to revise these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

 

Entire Agreement

These Terms, together with any legal disclaimers and privacy notices posted on our site, constitute the entire agreement between you and TS Capital Management concerning your use of the Services and supersede any prior communications.
